to us, you are communicating with us electronically. You consent to
receive communications from us electronically. We will communicate
with you by e-mail. You agree that all agreements, notices, disclosures
and other communications that we provide to you electronically satisfy
any legal requirement that such communications be in writing.

software, is the property of No More SIDS Foundation
and protected by United States and international copyright laws.
The compilation of all content on this site is the exclusive property
of No More SIDS Foundation and protected by U.S. and
international copyright laws. All software used on this site is
the property of No More SIDS Foundation or its software
suppliers and protected by United States and international copyright
laws.
LICENSE AND SITE ACCESS
No More SIDS Foundation grants you a limited license to
access and make personal use of this site and not to download (other
than page caching) or modify it, or any portion of it, except with
express written consent of No More SIDS Foundation.
This license does not include any resale or commercial use of this
site or its contents; any collection and use of any product listings,
descriptions, or prices; any derivative use of this site or its
contents; any downloading or copying of account information for
the benefit of another merchant; or any use of data mining, robots,
or similar data gathering and extraction tools. This site or any
portion of this site may not be reproduced, duplicated, copied,
sold, resold, visited, or otherwise exploited for any commercial

Foundation's name or trademarks without the express written consent
of No More SIDS Foundation. Any unauthorized use terminates the
permission or license granted by No More SIDS Foundation.
YOUR ACCOUNT
If you use this site, you are responsible for maintaining the confidentiality
of your account and password and for restricting access to your
computer, and you agree to accept responsibility for all activities
that occur under your account or password. No More SIDS Foundation does sell products for children, but it sells them to adults,
who can purchase with a credit card. If you are under 18, you may
use No More SIDS Foundation only with involvement of
a parent or guardian. No More SIDS Foundation reserves
the right to refuse service, terminate accounts, remove or edit
content, or cancel orders in their sole discretion.
RISK OF LOSS
All items purchased from No More SIDS Foundation are made
pursuant to a shipment contract. This means that the risk of loss
and title for such items pass to you upon our delivery to the carrier.
PRICING
Prices are subject to change on the site without notice. In the event
a product is listed at an incorrect price or with incorrect information
due to typographical error or error in pricing or product information
received from our suppliers, No More SIDS Foundation
shall have the right to refuse or cancel any orders placed for
product listed at the incorrect price. If your credit card has
already been charged for the purchase and your order is canceled,
No More SIDS Foundation shall immediately issue a credit
to your credit card account in the amount of the charge.
Sales Taxes & Duties
No More SIDS Foundation shall automatically charge and
withhold the applicable sales tax for orders to be delivered to
addresses within the state of California. Each customer shall be
solely responsible for all sales taxes, or other taxes, or duties
on orders shipped to any country outside the United States.
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
All of No More SIDS Foundation's products are guaranteed
against defects for 30 days from the date of purchase. Except as
expressly stated herein, No More SIDS Foundation makes
no representations or warranties, either express or implied, and
expressly disclaims all warranties, either express or implied,
of any kind, with respect to products sold on the No More SIDS
Foundation site, including but not limited to, merchantability
and fitness for a particular purpose. You agree that the sole and
exclusive maximum liability to No More SIDS Foundation
arising from any product sold on the No More SIDS Foundation site
shall be the price of the product ordered. In no event shall No
More SIDS Foundation, its directors, employees or other representatives
be liable for special, indirect, consequential, or punitive damages
related to any product sold.
APPLICABLE LAW
By visiting No More SIDS Foundation, you agree that the
laws of the state of California, without regard to principles of
conflict of laws, will govern these Conditions of Use and any dispute
of any sort that might arise between you and No More SIDS Foundation.
SITE POLICIES, MODIFICATION, AND SEVERABILITY
No More SIDS Foundation reserves the right to make changes
to our site, policies, and these Conditions of Use at any time.
If any of these conditions shall be deemed invalid, void, or for
any reason unenforceable, that condition shall be deemed severable
and shall not affect the validity and enforceability of any remaining
condition.
